الثابت والمتغير في قضايا المرأة المعاصرة

لقد اشتمل القرآن الکريم على أصول الشريعة وقواعدها في الحلال والحرام، وجاءت أکثر أحکامه مجملة تشير إلى مقاصد الشريعة وتضع بيد الأئمة والمجتهدين المصباح الذي يستنبطون في ضوئه أحکام جزئيات الحوادث في کل زمان ومکان، وهذا سر خلود الشريعة وشمول قواعدها الکلية، ومقاصدها العامة لکل ما يحدث للناس من أقضيات، وتعد قضايا المرأة من أکثر القضايا إثارة، ومثيرة للجدل والخلاف، فتتباين فيها الرؤى تبعًا للعرف تارةً، أو التعصب المذهبي تارةً، أو الانفتاح على ثقافة الآخر تارةً أخرى، ولذا جاء هذا البحث لدراسة بعض قضايا المرأة المعاصرة وبيان رأي العلماء القدامى والمحدثين منها، ومدى قابلية تغيير الفتوى بتغير الزمان والمکان والناس، والتأکيد على مرونة الشريعة الإسلامية وأنها صالحة لکل زمان ومکان، مع بيان الثابت والمتغير وضرورة التوفيق بين الثوابت والمتغيرات في معالجة هذه القضايا، ويهدف هذا البحث إلى تحرير المرأة من آثار الغزو الحضاري الغربي، وإظهار حرص الإسلام عليها ومراعاتها في کل شؤونها، وکذلک الترکيز على المبادئ والقيم الإنسانية والاجتماعية مثل العفة، والحياء، وأيضا لبيان تصنيف بعض الأحکام المتعلقة بالمرأة إلى ثوابت ومتغيرات، واستخدمت في هذا البحث المنهج الاستقرائي الناقص، حيث قرأت ما استطعت الوصول إليه من کتب حول هذا البحث، کما استخدمت المنهج التحليلي، حيث عکفت على کثير من القضايا بالشرح والتحليل، وقد جاهدت أن أدرس هذه القضايا غير متعصب لرأي أو مذهب، کما استخدمت المنهج الاستدلالي، لأنني احتجت إلى الاستعانة بالاستدلال العقلي الذي يبنى على قواعد التأمل والتفکر للوصول إلى الحقائق، کما قمت بتدعيم البحث بآيات من القرآن الکريم والأحاديث النبوية التي يستقي منها الموضوع أصالته، وخلص البحث إلى أن الشريعة الإسلامية جاءت شاملة ومتجددة؛ لمواکبـة المتغيرات التي تحصل في حياة الإنسانيـة، وکذلک أن من الأحکام الشرعية منها ما هو ثابت لا يتغير ولا يجوز فيه الاجتهاد وإبداء الرأي، ومن الأحکام ما هو خاضع للرأي والاجتهاد وعرضة للتغيير والتبديل وفق ضوابط وشروط محددة، وتوصي الدراسـة ببحث کافة القضايا المتعلقة بالمرأة في الفکر الإسلامي قديماً وحديثاً في شکل موضوعات وأبحاث؛ لبيان وإظهار مدى صلاحية الشريعة المحمدية لکل زمان ومکان، کما توصي بالدعوة إلى إنشاء جمعيات نسائية إسلامية متخصصة في شتى المجالات.

Research with verses from the Noble Qur’an and Prophetic hadiths from which the topic derives its originality, and the research concluded that Islamic Sharia was comprehensive and renewed; To keep pace with the changes that occur in the life of humanity, as well as the fact that among the legal rulings are those that are fixed and do not change, and it is not permissible to make ijtihad and express an opinion, The study recommends examining all issues related to women in Islamic thought, ancient and modern, in the form of topics and research; To demonstrate and demonstrate the validity of the Mohammedan Sharia for every time and place, and also recommends the call for the establishment of Islamic women's associations specialized in various fields.
